Welcome to SpeakUp. By downloading, accessing, or using the SpeakUp mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
SpeakUp grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
You retain all rights and ownership in your audio recordings, scripts, and other content ("User Content") that you submit to the Service.
By submitting User Content, you grant SpeakUp a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and translate such content solely for the purpose of operationalizing the Service, providing you with feedback, and improving our AI algorithms.
You agree NOT to use the Service to generate, record, or upload:
The Service, including its "SpeakUp" trademark, logo, visual interfaces, compilation, code, and AI models, is the property of SpeakUp and protected by copyright, patent, trademark laws, and other intellectual property rights.
The AI feedback provided by SpeakUp is for educational and self-improvement purposes only. It does not constitute professional speech therapy, medical advice, or psychological counseling.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, secure, or free from errors.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Certain features of the Service may require a paid subscription. All fees are non-refundable except as required by law. We reserve the right to change our subscription plans or adjust pricing for our service in any manner and at any time.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in San Francisco, California.
If you are a consumer residing in the European Union, you benefit from any mandatory provisions of the law of the country in which you are resident.
